Terms & Conditions
By accessing and using the Little Designer Closet website at the ww.littledesignercloset.com.au, you are accepting and consenting to these terms of use. Little Designer Closet reserves the right to change these terms and conditions from time to time at its discretion.
1. Definitions
1.1 “Little Designer Closet” (also referred to as “we”, “our” & “us”) means Little Designer Closet (ABN 27886589054) and/or any person with authority acting on behalf of Little Designer Closet (ABN 27886589054).
1.2 “User” (also referred to as “client”, “customer”, “you” or “your”) means the user or any person acting on behalf of the User with the users authorisation.
1.3 “Services” means the Little Designer Closet website located at www.littledesignercloset.com.au (the “Site”) and related services including Little Designer Closet’s clothing & accessory rental services and its content (the “Content”).
1.4 “Order” refers to the User making payment to us in exchange for our services.
1.5 “Rental Period” means the 4 day or 8 day hire period selected when the User places an order. The start date indicates the day the order will be delivered to the Users nominated address, and the return date is the date the User is required to mail the items back to Little Designer Closet.
1.6 “Clothing” means all Clothing & Accessories supplied by Little Designer Closet to the User.
1.7 “Price” means the cost payable by the User to Little Designer Closet for the hire of the Clothing items.
2. Legislation
2.1 These terms are not intended to contract out of any provisions of the Commonwealth Competition and Consumer Act 2010 (“CCA”) or the Fair Trading Acts (“FTA”) applicable in each of the State and Territories within Australia.
2.2 These terms and conditions are subject to any laws or legislation that governs consumer rights.
3. Acceptance
3.1 Requests for services received by us, from the User, constitutes acceptance of these terms and conditions.
3.2 Where multiple Users have entered into this agreement, all Users are liable for adhering to these terms & conditions.
4. Price and Payment
4.1 The applicable Price is the current Price detailed on the Little Designer Closet website at the time a User places an order.
4.2 We reserve the right to change the Price if the User requests a change to their requirements.
4.3 For hired clothing, we reserve the right to request a bond payment which will be refunded upon the timely return of the Clothing in an acceptable condition. Should addition costs be incurred to us for cleaning or damage, these costs may be deducted from the bond payment by us.
4.4 Orders will not be fulfilled until payment in full is received.
4.5 Payment is to be made by the payment facility options made available on the Little Designer Closet website or by any other method agreed to between Little Designer Closet and the User.
4.6 Other payment methods are not recognised until the funds are honoured or cleared.
4.7 GST and any other applicable taxes or duties will be included in the price except where it is expressly stated that they are excluded from the price.
4.8 All prices are displayed in Australian Dollars.
5. Delivery of the Clothing
5.1 Clothing is deemed as delivered to the User (or third party nominated by the User where applicable) when the Clothing has been dropped off at the Users nominated delivery address.
5.2 The User must respond to an “Authority to leave” question prior to placing an Order on our site. If authority is granted, the User is liable for the Clothing from drop off at the nominated delivery address. Where authority is not granted, a calling card will be left and the User must arrange re-delivery or collection as required based on the Users location. Once that re-delivery or collection is complete, the User assumes liability.
5.3 Orders for in stock items will be shipped within forty-eight (48) hours of clear payment being received.
5.4 Little Designer Closet uses a range of delivery methods through various parcel postage and courier networks. Delivery within 2 business days is offered to those locations within the Australia Post Express Post network. Outside of this network, delivery may take longer.
5.5 Delivery dates or times provided by Little Designer Closet are approximates only. Little Designer Closet is not liable for variations in delivery date or time given that we rely on external suppliers for these services.
5.7 The User must still accept delivery of the Clothing even if delivered late. Little Designer Closet will not be liable for any loss or damage to the User as a result of late delivery.
5.8 For hire clothing delivery that is received late by the User, for reasons including (but not limited to) Courier delay, Use not available to accept delivery where authority to leave not granted or change of size is requested, must still be returned to Little Designer Closet by the rental return due date specified within the original Order.
6. Hire Clothing Rental Period and Late Fees
6.1 The Rental period commences from the date the Clothing is delivered to the address nominated by the User.
6.2 We reserve the right to deliver the Clothing earlier than the selected Rental Period start date. The User will be notified of dispatch and will be responsible for receiving the clothing upon delivery. Where we have arranged an early delivery, this does not alter the rental return due date.
6.3 The User is required to return the Clothing to Little Designer Closet on, or before, the rental return due date as specified when the Order was placed.
6.4 The User is required to return the Clothing using the pre-paid postal bag provided by Little Designer Closet.
6.5 The Rental period ceases when the Clothing is dropped off at the Post Office, or dropped in the Australia Post Express Post mailbox. Where the package is dropped in the mailbox, the USER is liable for the parcel until it is received by Little Designer Closet.
6.6 Where the rental return due date falls on a Sunday or public holiday, the User may return the Clothing the following day.
6.7 If the Clothing is not returned by the rental return due date, we are entitled to charge late fees of $30 for each day overdue, up to a maximum of 150% of the advertised recommended retail value of the Clothing detailed on our website. Late fee calculations will exclude Sundays & public holidays.
6.8 If the Clothing is not returned within ten (10) business days, we will consider the Clothing item/s as non-returned and a fee of 150% of the recommended retail value (as advertised on our website) will be payable.
6.9 The User authorises Little Designer Closet to utilise any bond payments held from the User to contribute to these fees.
6.10 Where a bond payment is not held, or is an amount less than the amount payable in fees, the User authorises Little Designer Closet to charge the outstanding fees to the User.
6.11 Where a recommended retail value has not been advertised on our website, the following values are to be assigned for the purposes of fee calculations outlined in this section: $120 for a single clothing item and $30 for a single accessory item.
7. Hire Clothing Risk
7.1 Liability for the Clothing passes to the User upon delivery or pick up of the Clothing.
7.2 The User accepts full responsibility for possession and care of the Clothing during the hire period.
7.3 Where the clothing is soiled beyond that which can be resolved under a standard dry cleaning service, and Little Designer Closet incurs additional cleaning fees, the User accepts that they may be required to pay for those additional cleaning fees.
7.4 Where the clothing is damaged beyond that which can be repaired in house, and Little Designer Closet incurs fees for a third party to undertake repairs, the User accepts that they may be required to pay for those repair fees.
7.5 Should the clothing become lost, stolen or damaged beyond repair the User accepts that they will be required to cover the replacement value of the Clothing. The hire fee already paid will be taken into account when calculating the replacement costs payable by the User.
7.6 The User agrees to section 7.5 even in the case where loss, theft or damage is not at the fault of the User or is not due to any kind of negligence on the part of the User.
7.7 Little Designer Closet reserves the right to request copies of the Users identification before fulfilling an order. This request is at the discretion of Little Designer Closet and may be required for orders of higher value.
8. Title to Hire Clothing
8.1 All Clothing items that are hired remain the property of Little Designer Closet at all times.
8.2 Little Designer Closet will make selected items of clothing available to Users for purchase, rather than hire. These items will be clearly identified as available to purchase. The ownership of these items will transfer to the User upon purchase.
9. Hire Clothing Defects
9.1 The User acknowledges that the Clothing provided may not be in a brand new condition. While Little Designer Closet will endeavour to ensure the quality of its Clothing provided is of a high standard, there may be minor imperfections due to general wear and tear.
9.2 The User must inspect the Clothing upon delivery and notify Little Designer closet, by either phone or email, of any defect, damage, missing items or differentiation from what was Ordered.
10. Returns / incorrect Sizing
Hired Clothing & Accesory items:
10.1 Users are permitted to cancel an order, without incurring any fee’s or penalties, given a written request is received by Little Designer Closet greater than ten (10) business days prior to the hire start date. A full refund will be processed.
10.2 Should the User request a cancellation within ten (10) business days of the hire start date, a cancellation fee of ten dollars ($10.00) will apply. A refund will be processed less the ten dollar ($10.00) cancellation fee.
10.3 Should the User wish to cancel an order once the order has been dispatched, a twenty dollar ($20.00) cancellation fee will apply. A full refund will be processed, less the twenty dollar ($20.00) cancellation fee, provided we are notified and the clothing is returned within 24 hours of delivery. Clothing must be confirmed by Little Designer Closet as unworn / unused before any refund is processed.
10.4 The User is responsible for selecting the correct Clothing sizes. Should the User find that the Clothing size is incorrect, the User must notify Little designer Closet and return the clothing within 24 hours in an unworn / unused state. We will endeavour to provide you with an alternate size (if available), and will express post this out to the User. The cost of additional shipping is to be paid for by the User. Should we be unable to provide an alternate size, a refund will be processed less the shipping fee’s.
Purchased Clothing and Accessory items:
10.5 A refund will be considered for Retail Clothing and Accessory items purchased from Little Designer Closet where:
- Products provided are not of acceptable quality
- Do not match descriptions made by the salesperson, on packaging and labels, and in promotions or advertising
- Are not fit for purpose
- Do not meet any extra promises made about performance, condition and quality
- Do not meet any other consumer guarantees outlined by the ACCC
10.6 An Exchange may be considered for incorrect sizing selection, however a refund is not permitted. Sizing guidelines are provided to the User in product listings descriptions. We will endeavour to exchange for correct sizing where stock is available.
10.7 An exchange may be considered for change of mind, however a refund is not permitted. 
10.8 No Exchange or refund on 'Soapbox Kids' Clothing items that are made to order. Given these items are made to order, they can therefore not be returned.
10.9 Any refunds outlined in this section will be processed within three (3) business days of receiving both the written request (containing account particulars required for refund processing) from the User, and the Clothing returned and confirmed as unworn. Any payments made through Paypal will be refunded through Paypal.
10.10 Little Designer Closet cannot guarantee the time it will take for the User to receive the cleared refunded funds. This is subject to the processing time of other providers, and as such is outside of the control of Little Designer Closet.
11. User's Responsibilities for Hire Clothing
11.1 The User is required to maintain the Clothing within their own possession and control at all times. The clothing must be maintained in good condition as it was upon delivery, with the exception of reasonable wear and tear.
11.2 The User may not reassign the hire contract to another party.
11.3 The User must return all the Clothing to Little Designer Closet on, or before, the hire period end date.
11.4 Immediately advise Little Designer Closet of any loss, damage or theft, including non-delivery on the delivery due date
11.5 Make no alterations to the Clothing items.
11.6 The User must refrain from undertaking any cleaning or repairs to the Clothing either personally or through a third party unless consent os expressly provided by Little Designer Closet.
11.7 The User is not permitted to iron the Clothing items. Use of gentle clothing steamers are permitted, however the User accepts responsibility for any damage to the Clothing during this process.
11.8 The User is required to provide at least ten business days notice, in writing, of any proposed change to the Users details that have been provided to us.
11.9 Any fees and payments outlined in these terms, other than original hire and shipping fee’s paid when the Order is placed, must be paid by the User within 14 days of request from Little Designer Closet. The only exception to this is at the discretion of Little Designer Closet, and will be based on an agreements between the User and Little Designer Closet.
12. Cancellation
12.1 Little Designer Closet reserves the right to cancel the delivery of Clothing at any time prior to delivery to the User. Little Designer Closet will provide written notice at the earliest possible time should an Order be cancelled. A full refund of all payments made to Little Designer Closet, in relation to the cancelled Order, will be provided.
12.2 Little Designer Closet shall not be liable for any loss or damages, incurred by the User, as a result of cancellations as detailed in 12.1
13. Hire Default
13.1 Should Little Designer Closet incur any costs or expenses involved in the recovery of Clothing or funds owed to Little Designer Closet by the User, then the subject User shall be responsible for reimbursing Little Designer Closet for these costs or expenses
13.2 If the User is in breach of the terms outlined in this document, Little Designer Closet may repossess the Clothing, or suspend the supply of Clothing to the User. Little Designer Closet will not be liable for any loss or damages incurred by the User as a result of repossession or suspension.
14. User Generated Content
The User grants Little Designer Closet a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute any content that you submit such as data, text, images, files, links, software, chat, communication, photo’s, reviews and any other material. The User grants such content to be incorporated into any form, medium or technology without compensation to the User.
Any content submitted to Little Designer Closet may be used at our sole discretion. The user allows Little Designer Closet the right to change, delete, or condense any content. We may make changes to, or discard, any content. We reserve the right to remove or refuse any submitted content for any reason.
Users warrant that any content submitted to Little Designer Closet meets the following requirements:
• The User is the sole author and owner of the intellectual property rights
• Is accurate and true
• Does not violate the terms outlined in this document
• Does not and will not cause injury to any person or entity
• “Moral rights” have been voluntarily waived by the User
Users agree to not submit any content that:
• May violate any regulation, law or statute, or be considered unlawful
• Is false, misleading or inaccurate (to the Users knowledge)
• May be considered defamatory, biased, offensive, threatening or harassing to any individuals or entities
• May contain any potentially damaging computer programs or viruses
• Infringes any copyright, trademark, patent or any other legal rights held by any individuals or entities
• Contains any references to other websites or contact information of any kind
In the case of a breach of the Users representations and warranties set forth above, or your violation of any law or the rights of a third party, the User agrees to indemnify and hold Little Designer Closet harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown.
15. General
15.1 These terms and conditions, and any contracts where these apply, are govered by the laws and legislation of New South Wales.
15.2 Little Designer closet is under no liability to the User for any loss or expenses incurred by the User as a result of Little Designer Closet being unable to adhere to the Services offered under these terms. Should any liability be considered, it shall not exceed the price paid for Little Designer Closets Services.
15.3 Should any clauses within Little Designer Closets Terms and Conditions be invalid, illegal or void, this shall not alter the validity of the remanning clauses within this document.
15.4 Little Designer Closet reserves the right to review and make changes to these terms and conditions at any time. Where changes are made to these terms and conditions, the change will take effect from the day which Little Designer closet notifies the User.
15.5 The User agrees to Little Designer closet being able to use images for promotional purposes where they have been sent in or tagged by the User wearing Little Designer Closet Clothing. This may include (but not limited to) use of these images on social media platforms, Little Designer Closet website, newsletters etc.
15.6 If default results from any act of God, environmental disasters or any other event beyond reasonable control of both the User and Little Designer Closet, then neither party shall be liable.
15.7 Should Little Designer Closet fail to enforce any aspect of these terms and conditions; this does not waive or void the terms. The terms remain in place and enforceable.
